IBM Gets 30-Day Extension in SCO Case

Now that IBM has gotten the billion-dollar SCO suit against it moved from state to federal court in Utah - without any complaint from SCO - SCO's lawyer says he doesn't care what court hears the case - IBM has asked for a 30-day extension before it files its reply. SCO's not arguing about that either. The move will give IBM until April 20 to answer and since April 20 is Easter Sunday, one gathers the paperwork won't turn up in court until what used to be called Easter Monday.

The latest unconfirmed buzz on the tactics IBM's law firm Cravath, Swaine & Moore is adopting to deal with the suit filed by former Cravath partner David Boies is reportedly to get the thing out of Utah altogether - away from the Mormon old boys' club - and into federal court in New York, losing SCO's request for a jury trial somewhere along the way. Juries tend not to follow complicated prior art arguments, or so the thinking goes.

Meanwhile, SCO has warned the SEC that its legal bills could be stiff and that the revenues it gets through IBM and its partners could plummet, a point we think we already made.
