Lindows Bests its Insurance Company

(April 14, 2003) - Lindows.com CEO Michael Robertson confessed the other day that he's been quietly fighting a second legal battle related to the trademark infringement suit Microsoft filed against it.

Seems Lindows' insurance company St Paul Fire and Marine refused to help it defend itself against the Microsoft suit, a bill now reportedly running "well into the seven digits," Robertson said, even though Lindows' policy provides for that, and that St Paul sued it.

However, apparently much to Robertson's relief, Lindows got a summary judgment in the St Paul case at the end of March, finding St Paul in breach of contract and liable for indemnification.

Robertson suggests that Microsoft and St Paul are in cahoots because "St Paul has had marketing and business ties to Microsoft in the past" and that Lindows "has been forced to file a 'bad faith' claim against St Paul to try to get to the bottom of this situation."

Well - this is an unusual tactic in order to increase the 'buzz' surrounding the Lindows alternative to Microsoft.

I find this article a little bit short on details - in so much as it'd be nice to understand more about what sort of contractual obligations are made by Lindows customers under which they are forced to defend themselves to 'dipping their foot into the pond'.

The one good thing about this article is that it shows us that companies caught in the operating system crossfire have to learn to play by the rules themselves. ;)
